I'm here at the school library. I always come here during my breaks. I have been wrecking my brain for a few minutes now. Constitutional Law is too difficult to understand. Why did the brilliant people during ancient times have to do this?
I can't disturb Cass right now since she had some errands to do. So now it feels like I'm wasting time reading and reading without comprehending anything.
"Wow that's like the longest sigh I've ever heard."
I had no idea I've been sighing. I looked up to see who was talking, and to my surprise, again, it was the pretty boy, the Nate Dawson.
"I'm sorry, was I too loud?"
"No it's alright. Everybody does that sometimes." Nate said.
I just smiled gratefully. But, when did he even get here? I did not notice that he was already sitting across me.
"So Samantha, what's pissing you off anyway that you had to sigh that long?" Nate said, smirking.
"Constitutional Law is evil!!! It's so hard to understand." I said, plopping my head to my book.
"Well, what can't you understand? Maybe I can help." He offered.
I don't know why but I had to look around the library first. Millie's warning was still in my mind, and I was scared that some of Ashley's friends would just grab my hair and pull me away.
"Don't you have other things to do?" I asked Nate, hoping he'd get the clue. I am REALLY scared of Ashley's friends.
"I'm here to study of course. I was just curious about which topic made you sigh that hard" Nate said while chuckling. Those freaking eyes oh god
"I'll be fine, thank you." I answered and buried my head into my book once more, hoping my IQ miraculously increased after that conversation.
A few minutes went by peacefully.... BUT I'M STILL ON THE SAME FREAKING PAGE.
What the hell is "Power of Judicial Review" and why is it so complicated for my little brain???
I just want to cry and go home and sleep and binge watch Suits, or How To Get Away With Murder, or The Big Bang Theory, or Brooklyn Nine-Nine, or Lord of The Rings, or just anything that would get me away from all these.
"The Court's Power of Judicial Review...... okay, what about it?" whispered someone behind me.
That familiar deep voice again. The voice that's giving me chills right to my bones.
I looked behind me and there he was. Trying to sneak another peek at my book.
I quickly closed my book and glared at him. The way he spoke felt like it was such a simple topic so I didn't want to get embarrassed any further.
"Oh c'mon, let me see. I just want to help you, you've wasted so much time on this topic already. Law school is very fast paced. You have to keep moving forward." He said, in a serious tone that made me a little frightened and pressured.
"Fine" I said, opening up my book once more. "I'm just really confused about this Judicial Review. I mean, there's the Doctrine of Separation of Powers, right? It's where the 3 branches of government — Legislative, Executive, and Judiciary — have their own powers and functions, and cannot meddle with each other's affairs. But like, there's the Power of Judicial Review, where the Judiciary branch reviews the functions of the Executive or even the Legislative. Isn't that considered meddling already?"
"I see. Well think of it this way. The Doctrine of Separation of Powers does not mean that everybody should mind their own business and not care about the other branches at all. This doctrine was actually established with the intent to prevent the concentration of power under one branch and to provide for checks and balances.
And regarding the checks and balances, that's where the Power of Judicial Review comes in. You already know that the Legislative creates the laws, the Executive implements these laws, and the Judiciary is in charge of the interpretation and application of these said laws.
When we say 'interpretation and application', the Judiciary determines the meaning of said law, and also the meaning of the relevant portion of the Constitution. This is in order to decide whether there is a conflict between the law and the Constitution. Remember that the Constitution is the supreme or highest law of the land, so all other laws must agree to it. Therefore, if there is a conflict between a certain law and the Constitution, then that law will be declared invalid and unconstitutional.
So basically, it's not really meddling. They're just there to make sure that each branch doesn't go beyond their official functions and to guarantee that nobody abuses their power."
Nate explained. WOW, JUST WOW. You know when people say intelligent men are more attractive? Get this. Imagine an already very attractive man, saying something so intelligent. Again, WOW.
I now understand all the fuss towards him. He really is one of a kind. And that explanation was so brilliant. I think everything's making sense now little by little.
"So.... the determination whether a law is valid or not, that is part of the Power of Judicial Review, am I right?" I asked nervously, hoping he would not think I am very stupid.
"YES! You got it!" Nate exclaimed, a little louder than allowed, probably forgetting we're in the library.
Some students looked in our direction, and the librarian said "Shush, Mr. Dawson". Nate just chuckled and looked at me, his blue eyes shining. He smiled widely, and looked at me proudly as if I've received a very prestigious award. He really is a very gorgeous person.... and with that realization, I looked around again to see if there were angry eyes around us, because I don't really want to be involved in any relationship drama here.
I read a few pages more and when my eyes are giving up, I stood up and got ready to leave. Also, Nate is now sitting beside me, and I really did not want attention, especially if it's about me and him.
"Thanks so much, Nate! I really appreciate it. You have no idea how much you've helped me. I gotta go now, though. Thank you, really." I said, giving him my warmest smile to let him know that I really appreciate his help.
For some reason, Nate looked a little surprise but tried to hide it quickly and he went back to his normal poker face reaction. He then nodded and said, "You're welcome".
I was about to leave when Nate spoke again, "Uhm Samantha? In case you need help with any subject, just .... uhmm... just let me know." He said this in a serious tone, and yet his eyes looked like they were.... pleading? Am I imagining things now?
I didn't want to reject him, because I already have Cassie so like, I don't really need him. So I just smiled and said, "Thanks for the offer."
I hurriedly left the library because my heart was beating so fast. My face felt like it's burning, I probably am as red as a tomato right now. I can't get his smiling face, and especially his pleading eyes, out of my mind.
